Will I have to go to ‘Court’?

Employment disputes are usually dealt with in a tribunal, if no agreement can be reached. It is Milwyn Jenkins & Jenkins' practice to consider all options for trying to resolve issues of this kind in order to minimise the stress in what is already a difficult situation and to keep the costs as low as possible. If a negotiated agreement is not possible, we can commence tribunal action and advise you of the need, where appropriate, for taking expert advice and a barrister’s opinion. Compromise Agreements are an effective method of resolving a variety of employment disputes and are an effective and viable method of avoiding legal proceedings with costs and monetary consequences for both parties. How long does it take?

It usually takes about 2 - 3 months to reach a negotiated settlement. A claim for unfair dismissal must be made within three months from the date of your dismissal. In Milwyn Jenkins & Jenkins' experience, most cases are dealt with within 5 – 6 months from when proceedings are commenced.

What will it cost?

Litigation can be an expensive process.
